Same status in September. Did SH disappear with the money? DBN office closed, phone disconnected, automated email replies only.

Interesting enough DSG did accept our application for refund. But then doesn’t acknowledge any capability for a status update. Why to act as a front then?

It was interesting that to complete DSG registration, the San Hing closing bill needed to be paid in full and not debited from the deposit. Hope we get our deposit back someday.

I wrote a week ago to City Management pointing out that the change of supplier occurred at their behest and also they have oversight of the businesses in DB

I settled my gas bill the day that the service provider changed and yet I have still not had the refund. Ridiculous

Had a letter 2 days ago from CM that the refund cheque would be issued on 9th Oct...will keep you posted and suggest letters are written to CM

I have also emailed HKRI, as they decided to appoint DSG as the provider rather San Hing LPG, if you think of all of the clients who have not received their deposit refund the amount is huge, that they are withholding.

I contacted or tried to contact San Hing LPG and HKRI, I received a response, I believe from HKRI who advised that the person at San Hing had been admitted to hospital and is therefore uncontactable, they advised that ExxonMobil is the gas supplier and San Hing are the servicing agent. Wilson Chan the Estates Manager has advised they will continue to contact San Hing for a response.

I have $12K credit with San Hing.  They've been overcharging me.  I've talked to Mgmt office twice, DSG many times, e-mailed SH several times but still no reply.  I have a lawyer friend.  Shall I ask him?

Hi Sandy, I would imagine that DSG would not be interested as San Hing were the administrator prior to DSG being given the contract. I think HKRI must have some responsibility as they appointed San Hing in the first instance, it certainly can`t hurt by talking with your friend.

Perhaps an online petition is a good next step. Anyone knows how to set it up?

We need HKRI to get San Hing to provide an account of progress and planned schedule of refunds as a matter of principle and transparency. Otherwise stronger collective or individual action should ensue.

It would help to know how many are affected. Some of us in older buildings have no choice but to stick to gas. I would love to switch over to full electric but they said my building is not sufficiently wired and unlikely to be.

If a unit were sold, how would the refund be handled if there is no way to communicate with San Hing? All the replies from Wilson Chan office are "We will ask" with no results.

If our contract is with SH solely and they moved changing their place of business, then their legal obligation surely requires them to inform us.

If HKRI is an agent or middleman then we should be able to serve notices to them for SH. The point of contention here is the lack of proper public response from CM or HKRI. I have asked them if they could please post public notices regarding this matter to reassure us but nothing done.

They're kicking balls while trying our patience and someone being on medical leave is no excuse.

Has anyone any idea which government office is in charge?

Perhaps the Press might add publicity and pressure so potential buyers could know how well served DB is by their management.

My lawyer friend suggest to file a complaint to consumer council or police.  It's better to get more people and file together. Or we can sue them to Small Claims Tribunal but this will take time.

I submitted the complaint to consumer council and they replied that they contacted Exxon Mobil, parent company, and waiting for the reply. See what they can do...

I have called multiple times Wilson Chan’s office so they have my records.

I might withhold management fees payment until resolved.

Then another complaint to Consumer Council about DB management not handling the transition properly so this will be on record.

A letter from DB Services Management Ltd  (27 Nov)

You may be aware that in mid October 2020, it was reported that the person in charge of San Hing is unable to work due to health condition and could not be reached. In this situation, we are not in a position to advise you when the refund process could be resumed and completed.

Although there is no feedback from San Hing, City Management is still keeping to send a list of owners' enquiries regarding deposit refund to San Hing regularly
and urge San Hing to respond as soon as possible. On the other hand, we have written to the director of ExxonMobil, the gas supplier while San Hing as the gas agent, is responsible for the acts and omissions of San Hing, to intervene and resolve the dispute with owners amicably.

Recently, The Unfair Trade Practice Investigation Group of Customs & Excise Dept and the CID of the Police Force, upon receipt of complaints, approached City Management Office respectively and inquired about the suspected default deposit refund by San Hing. Relevant information was given to them for further investigation.

City Management will render assistance as appropriate and keep you informed of the development

The penultimate sentence is doubtful. Appropriate assistance would be to pay the deposit out of the "sweetener" probably received from the new company.

If mounting evidence of fraud is clear, then the Police or other government authority must step in?

DB Management should take this step on behalf of Residents affected. They own this problem. They have resources. Their credibility is at stake.

A general question about utility deposits: What is the law requiring their safe keeping for refunds like an escrow or bank account or are they for Companies to use interest free?

I sent an email to Amy Yung, and asked for her support regarding San Hing LPG`s inability to refund the deposits of I suspect the majority of DB residents, She advised, that She Will the list to the police. Their Serious Crime Bureau is conducting an investigation.
