Horrible property agent experience! ><

Nowadays, are property agents professional enough to show us their temper and directly ask us to sue them after they let someone enter our flats without our consent after the completion date of the property purchase?!  Huh

My agent did not inform me that she just left my to-be-collected-by-me key on her desk freely to let someone else take it and enter my purchased flat. Then she still had no intention to let me know her action until I found evidence of someone(more than one) entering my flat, moved my furniture, smoked and even took(better say 'stole') my possessions!   Shocked

My agent kept me from knowing all these until I made her confront the situation to me.

Instead of a sincere apology, she even shouted at me saying '

1. O yes, I really don't know why I didn't inform you about that ~.

2. Missy, I'm very busy ga. I don't remember it's today or yesterday that they entered your flat la!!  Angry

3. If you don't like it this way, go ahead to sue me lor!!!  Angry Angry Angry Angry

At last, she ended the conversation by urging for her commission like this:

Wei, the commission is due lo wor, when will you give it to me?!  Shocked


WHAT A TERRIBLE EXPERIENCE!!!!!!!

The worst part is, my new purchased flat is burgled before moving in! ><

I absolutely receive no respect from my agent and I question her professionalism and ethics. She couldn't even take care of her Property Agent Responsibility 101 - keep the owners' keys right.  Angry

The agent asked me to sue her if I didn't like the way she acted. Can I really do that? Is it a criminal to enter someone's flat without the owner's consent? even the previous owner after the completion date of purchase?

What do you think?...  Sad

Maybe you can consider file a complaint to the Estate Agents Authority! http://www.eaa.org.hk/welcome.htm

gosh what a shocking experience! Why don't you at least tell us her name and what agency she is with, so that we never use her!!!

Thank you for your site n comment. The boss/manager of the property agent is going to report to me about this today and I'll see how he takes care of this case. If they still upset me, definitely I'll file a complaint to the Estate Agents Authority! Smiley

I had the same experience years ago. Maybe the same agent? Wanted commission upfront, even before loan was approved, and had to beg (demand) keys to property. Now I am told that is typical of real estate agents in Hong Kong.  Sad

I know people use the term "my agent" loosely but if she really signed a contract as your fiduciary, these actions if proven true, could have even more serious consequences for her.

I would say unprofessional behaviour aside (and you should definitely complain to the licensing authority even if resolved to your satisfaction), unlawful entry and theft should also be reported to the police. This is impt in case of future incidents involving the same agency or agents.

Don't forget the other side of the story  though  Wink Grin If you disclose names, she/they could sue you for slander.

If you haven't paid the commission, you should deduct the losses or negotiate a reduction as compensation.

Tbrcgrad: Sorry for you about your situation years ago too. However, my previous agent (in Tung Chung) before this case was so much better and professional than the younger ones nowadays.

I start to think that this is a serious problem of the younger generation. I don't want to over-generalize about everybody, but it seems to me that most my family members experience more or less the same poor customer service from telecom subscribers, fitness centres, and even banks! (I was so unlucky that I have a poor banker service in DB about this purchase too, but luckily the manager took good care of my case now! :-D)

Thank you so much for your valuable advice and reminder. My husband and I both believe that this is such a serious fault that she'd made and that we're treated disrespectfully. They always just focus on the small household electronic appliances taken and blamed the black rainstorm hoisted last Wednesday. They completely ignore the principles of property 'agent''s ethics/practice that they had to receive our consent to let her use our keys to enter our new purchased flat as well as our permission to let anybody enter our property!  Angry

Anyway, I'm going to expect the response/report from the manager today. I'll see what he'll say.

Thank you very much for your advice. I'm totally NOT wet my feet on any slander issues. Wink I'll file my case to the corresponding governmental departments and let the news broadcast/disclose their names!!  I'll seek for more legal advice soon.  Wink I'm so keen to report this to the police soon too! We've got to uphold the peacefulness within DB!!  Cheesy

The manager who promised that he would get back to me about my case today and apparently, HE DIDN'T!  Shocked

I'm afraid I'll have to take a more serious action...  Angry

If you have no action taken, don't expect he will care you indeed. This is typical HK style! File a complaint first!

Just spoke to the manager and he said he's got everything back ready for me to collect at anytime.

About his staff, he's surprised if that's true. He'll look into the problem further.

He'd like to meet us tomorrow...

Interesting!  After this is over, we need to know which agent this is.  I'm dealing with agents right now and we should know who to avoid.

In fact I wonder if I should collect the electronic appliances now. I've been struggling whether I should still report this to the police(afraid of being too late now... Sad), as after all, there could be a CRIME, because someone has entered and taken those electronic appliances away.

The agency said that they were taken by the previous owner. However, it was done after the completion date without informing us that our flat would be entered. I suspect if this is [u]criminal[/u] for someone to enter someone else's flat without the present owner's consent, regardless whom the electronic appliances belongs to. (The electronic appliances were still there on the day of the final inspection before completion and on the day on completion too. I asked if the previous owner still wanted those and the agent answered they didn't want it anymore.)

I completely lost the confidence of the agency and wonder if those electronic appliances still remain in the form as they were before taken.

Huh ***I doubt if there could be any small explosion or damages in any kind once I plug them and use them again.***  Undecided

Sad Sad I also wonder if I should trust the agency too, saying that they were taken by the previous owner. This might not be the truth...


I'm going to meet the manager now. Let's see what will happen!  Cool

After reading all your posts, I think I can handle a solution. Please PM the name of the Property Agent with phone and address. Also, I think you should file a report immediately. If you with hold the agency from other DB residents, they too may become victims.  Angry

Sounds like this was a miscommunication caused by the agent. She told you the previous owner didn't want any of the items left over in the property but then they went back and took it anyway.

The link you were given (part c) says the agent should have written up a list of items inside the property that will transfer ownership to you. If the agent didn't prepare this list, then it can be interpreted that she breached the law.

Since you now own the property, the first thing you should do is change the locks on your front door immediately.

The issue is not really with the agent but with the previous owner who "trespassed" on your property. But were the items taken important enough to you that you want it back? If so, you can demand it to be returned if you have the written inventory. Otherwise, I doubt there's anything you can do.

People have different experiences. Maybe you feel the service you received was unsatisfactory while someone else was happy with that same agent. It's only theft if the items taken were yours to begin with. If they belonged to the previous owner, that's not really considered theft unless you choose it to be.

I think it would be best for you to call the previous owner and find out if they took anything, what they took and whether you want it or not before you consider escalating the matter.

The OP's first post said someone (not the previous owner) trespassed and stole property after closing. Sounds like an excuse to say it was the previous owner to protect their friends who possibly do this on a regular basis - make use of properties in transition to have fun, etc. with the cooperation of agents. All agencies know when a property is sold, they still have keys so take advantage of the situation.

I still think a formal complaint to the licensing body as well as a police report should be filed to put this agency, the agent and all agents on notice.

That's why some owners do not allow their keys to be copied and require only showings accompanied by their own trusted agent (who truly represents them).

technically this would be a criminal case unless you have hard evidence you cannot sue the agent but you can file a complaint with the EAA if you want some more advice you can PM me just to keep it out of the public eye.
